After nearly a century of Disney exclusivity, the original version of Mickey Mouse has finally entered the public domain. The copyright for the iconic character, created by Walt Disney and Ub Iwerks, expired on January 1, 2024, and the gaming community has wasted no time in incorporating the beloved rodent into their upcoming titles.

As Mickey Mouse is now in the public domain, his likeness, particularly the original Steamboat Willie version, can be used by anyone without incurring costs or obtaining approval from Disney. First Moves: Movies and Games Emerge

Developers are already embracing the freedom to use Mickey Mouse without Disney's consent. We've seen the debut of a movie trailer titled Mickey's Mouse Trap, featuring the Steamboat Willie version of the character, as well as the emergence of indie games that have embedded Mickey into their narratives. For instance, co-op horror game Infestation 88 introduces Mickey as a mysterious rodent leading the pack of infected creatures.

Additionally, Inverse Ninjas VS. The Public Domain, a wave-based top-down shooter, takes pride in having introduced Mickey to their game just twelve hours after the copyright expired. Games, movie, and other content incorporating public domain Mickey continue to rise in number, offering anything from co-creation jams to fresh perspectives.

How the Release of Mickey Mouse Affects the Games Industry

The move means creators can now develop, market and release games without any need of official Disney permission. As Infestation 88 shows Mickey is no longer simply confined to kids gaming. For one reason or another we will see far off interpretations in kids-focused and other areas.

It also means pre-licensing Disney approval with additional royalty fees no longer apply. 2024, may signal a tipping point for upcoming iterations. Notable public domain game jams which debuted their game inspired by public domain – 2024 include Techdirt – which continues – extending the imagination for future public domain copyright material (e.g. The original Metropolis movie, novels released in 1923 U.S. copyright law is set to capture the next run.)

Unlike in 1984 and 1998 when Congress did – extending Disney's copyright protection for 20 year, the reason behind the decision to cancel it has not been made explicit. What we can say is Mickey has now finally moved into a brand new era and developers the means the games that creators bring forward more engaging than ever before with free reign.
